Also when you’re using downloaded games, you run the risk of being permanently banned from using xbox live.

Microsoft is able to recognise when a console is using a pirated game and if the console is flashed. The console’s unique CPU is recorded and then permanently banned from xbox live. This isn’t the issue when using copied games. With your game copier software you will be able to completely duplicate the original game disc that can the be used in your xbox without it needing to be flashed.
